Terms & Conditions Carriage of Persons by the Hythe Ferry and Pier Train 8 November 2014
1 Definitions and Interpretation
1.1 In these terms and conditions when we use any of the terms “we”, “us”, “our”, or “company”
we are referring to Blue Funnel Ferries Limited operating under the name Hythe Ferry,
together with, where applicable, all employees of that company.
1.2 When we use either of the terms “you”, “your”, or passenger we are referring to you and all
of the people who will travel on a ferry or pier train operated by the company. These terms
apply to all such persons.
1.3 “Ferry” refers to any vessel operated by us in the provision of a ferry service.
1.4 “Customer” includes, without limitation, all passengers and persons entering into transactions
with the Company
1.5 “Transaction” means any arrangement between a customer and the Company in connection
with any of those matters undertaken by the Company.
1.6 The Company is not a common carrier and, in these terms, and conditions does not contract
as such.
1.7 Children means between the ages of 5 and 15, Adult 16 yrs. to State pension.
2 Your Acceptance of these Terms and Conditions
2.1 These terms and conditions apply to passengers travelling on the Hythe Ferry, Pier
Train service & pedestrians, including without limitation its regular operation across the Port of Southampton between Town Quay Southampton and Hythe Pier and any other services operated in addition to scheduled crossings.
2.2 The Company reserves the right to amend these terms and conditions from time to time
without prior notice superseding all previous editions.
2.3 These terms and conditions will apply to the use of all valid tickets recognized by the
company issued by us or another travel operator or agent.
2.4 Restrictions may apply to any tickets purchased in relation to a special offer or other
promotion. Please refer to the relevant promotional materials.
2.5 While we try and ensure that all prices, times and dates quoted by our website or social media publications are accurate, we cannot be held responsible for any errors that may occur.
3 Timetables ‘.
3.1 While every reasonable effort is made to avoid disruption, operational reasons may mean
that the ferry or pier train may have to leave before or after advertised times.
3.2 The company reserves the right to vary timetables without prior notice.
3.3 The service is maintained at scheduled times unless it is interrupted by extreme weather,
technical difficulties or by direction of the CHA. (Competent Harbour Authority)
4 Conditions of Travel
4.1 The Company reserves the right to refuse to allow any person to travel who, in our opinion,
is unfit to travel on our service for any reason.
4.2 At our discretion the Company can refuse to deny any passenger wishing to travel with
goods or any other property which are unfit to be carried on a ferry for any reason.
Small Children and animals
5.1 Children under the age of 5 travel free of charge. Any person travelling on a child ticket
must be accompanied by a responsible adult unless prior arrangements have been agreed
with the Company or in unmitigated circumstances.
5.2 Dogs and other domestic pets accompanying passengers travel free of charge and remain the responsibility of their owner. Such person(s) shall be responsible for any loss or damage
caused by the animal(s) to the Company’s property and the person or property of other
passengers, and all expenses arising there from or of our agents, employees and sub-
contractors. The company may request passengers with domestic pets postpone their
crossing in busy periods and pets should remain in their cages or on leads to retain control.
6 Fares & Tickets
6.1 Only the person for whom a ticket was purchased may use the ticket. It cannot be resold or
passed on to any other person.
6.2 Solent Go Cards, please visit www.solentgo.co.uk for terms and conditions. There are no refunds given against these products by Hythe Ferry when purchased on-line. (Please see Solent Go website. On occasions departure times may vary from published times without prior notice.
6.3 Tickets and season tickets remain our property and must be given up for inspection or
collection on demand by our employees or nominated agents.
6.4 All published fares are subject to availability. We also reserve the right to apply a surcharge
to any of our fares on the date you pay for your ticket, for example a fuel or insurance
surcharge. We will notify you of any such surcharges before you purchase any ticket.
7 Refund Procedure
7.1 Tickets will only be refunded to the maximum value of any unused portion remaining.
7.2 Refunds can only be issued at the Hythe Ferry Office, Prospect Place, Hythe, Southampton,
S045 6AU or by applying in writing.
7.3 The company will not be responsible for any lost, stolen or destroyed tickets and no refunds
will be made in respect of these.
7.4 A refund can be made if required, to the value of any journey not made as a result of delay
in scheduled service.
7.5 In the event passengers should choose to make alternative travel arrangements as a result
of any delay in service, the company holds no responsibility for any additional costs incurred
by passengers, including any cost relating to missed connecting services, or onward
journeys.
7.6 There are no refunds on Solent Go Products when purchased On-line from www.solentgo.co.uk (See website T’s & C’s)
8 Carriage on other Carriers
8.1 The company will only issue tickets for use on other transport as agents for the carrier(s)
concerned and travel will be subject to their terms and conditions.
9 Security/Search
9.1 Passengers thought to be carrying any prohibited materials or substances will be subject to
a security search and any items found will be seized. Anyone failing to agree to a search
will not be permitted to travel.
9.2 If any passenger wishes to carry firearms or explosives (as defined by the Aviation and
Maritime Security Act) this must be declared to the company at least 24 hours prior to
travelling and the company reserves the right to refuse to allow shipment. Any firearms
should be accompanied by a current valid certificate and shall be handed in prior to
embarkation and returned upon arrival.
9.3 Any firearms or explosives, which we, in our absolute discretion, permit to be carried on
board the ferry, shall be entrusted to us prior to embarkation or loading, and only returned
upon departure from company property upon arrival.
10 Safety on Board and on Company Property
10.1 For the safety of yourself and all other passengers and crew, you should comply and take
notice always of the recorded safety message, all instructions and directions issued by the
company staff and crew, abiding by notices displayed whilst on board and on company
property.
10.2 We operate a strict no smoking policy on board and throughout company premises.
11 Dangerous/Illegal Articles
11.1 Any passenger who takes on board any dangerous goods or any materials proved to be
hazardous which do not conform to the regulations relating to the carriage of dangerous
goods by sea shall be deemed responsible to indemnify us for any loss we suffered both
incidentally and directly caused, in addition to any penalty imposed by law.
11.2 We reserve the right to dispose of any goods or articles referred to in 11.1 above at the cost
of the passenger.
12 Lost and Abandoned Property
12.1 All goods and property remain the responsibility of the passenger. The company cannot
be held responsible for any such loss, or damage unless deemed to be a direct result of our
negligence.
12.2 Any lost property will be retained for a period, but the company will not be held responsible
for any loss or damage during this period. We reserve the right to make a reasonable
charge for the return of such property to its owner.
12.3 Any property not claimed within 3 months of being so left will be regarded as abandoned
and may be sold or otherwise disposed of by us at our discretion and we shall have the right
to retain any proceeds of sale. Any luggage or goods of a perishable nature or which in our
opinion may cause injury or inconvenience may be disposed of earlier than three months at
our absolute discretion.
13 Our Liability
13.1 Our liability is limited to that which applies under the Athens Convention.
13.2 Where the Athens Convention applies, any action arising out of the death of or personal
injury to a passenger or for loss of or damage to luggage (including bicycles) shall be time-
barred after a period of two years.
13.3 Our employees shall not be liable to you for any loss arising from any act, neglect or default
by them while acting in the course of their employment or in providing services. They will
benefit from all legal defenses and protections available to us and we will act on their behalf
in relation to this.
13.4 These limits on our liability shall apply to any action against us whether the action is
founded in contract or tort.
14 General
14.1 No failure by us to enforce or rely upon any of these terms and conditions shall be
constructed as a waiver or shall affect our right to enforce any other terms and conditions.
14.2 If any of these terms and conditions shall become or be declared invalid or unenforceable
by any tribunal or court of competent jurisdiction then such invalidity or unenforceable shall
not affect the remaining terms and conditions all of which shall remain in full force and
effect.
14.3 Our employees and agents have no authority to waive or vary any of these terms and
conditions.
14.4 We may contract with any other person at our absolute discretion for the whole or any part
of the carriage of you or your property pursuant to these terms and conditions.
15 Applicable laws and limits of liability
15.1 These terms and conditions shall be governed by and construed in accordance with the
English law.
15.2 Unless you are permitted by the Athens Convention to make a legal claim against us in the
courts of another country, you agree that English courts shall have exclusive jurisdiction to
hear all disputes or claims arising in connection with these terms and conditions
